Supreme Court declines nursing home case
CLEVELAND — The Mississippi Supreme Court has declined to hear an appeal from a Tennessee company rebuffed in its efforts to move 75 skilled nursing home beds from Cleveland to DeSoto County.
The state Court of Appeals had ruled last April for the City of Cleveland in the dispute.
The Appeals Court reversed a 2008 ruling by DeSoto County judge that would have allowed Mid-South Associates, LLC, of Cordova, Tenn., the owner of Joy Health and Rehab in Hernando, to relocate the beds to DeSoto County.
The trial judge had found DeSoto County needed more beds.
The Appeals Court said the Department of Health was correct in denying the move because there it would have limited nursing home care to indigent patients in the Bolivar County and Cleveland area.
