Attorneys want TVA CEO to give deposition
KNOXVILLE, Tenn — Attorneys handling lawsuits that seek damages for the Tennessee Valley Authority’s (TVA’s) 2008 coal ash spill have told a federal magistrate the utility’s top executive should give a deposition.
TVA attorneys at a hearing yesterday before U.S. Magistrate Bruce Guyton said Tom Kilgore shouldn’t have to give a deposition, since he wasn’t directly involved until after the Dec. 2008 spill at TVA’s Kingston Plant west of Knoxville.
Guyton did not immediately rule.
Attorneys for the hundreds of people seeking damages want to question Kilgore over three days.
Nineteen TVA employees have already given depositions.
The court has not yet ruled on TVA’s motion that since the spill happened while it was providing a government service it is immune from such lawsuits.
