Judge rules against Memphis gravel company

EUREKA — A judge has ruled that the Panola County Land Commission has authority to reject a permit sought by Memphis Stone and Gravel Co. to mine gravel in the Eureka community.

Memphis Stone wanted to move its present mining operation from Batesville to a 200-acre site along Eureka Road.

The land is currently zoned agricultural. Memphis Stone needed the special exception permit to relocate.

The land commission turned down the permit request. The board of supervisors voted 2-2 to uphold the commission decision.

Memphis Stone had contended that supervisors had the final authority over zoning issues.

The Panloian reports the judge ruled the county’s land use rules gave the commission the power to decide special exceptions.
