Utility district wants city's annexation plan tossed

GULFPORT — A utility district contends in a court motion that the City of Gulfport has failed to follow state law in its attempt to annex 2.5 square miles around Mississippi 605.

The Sun Herald reports the Northeast Harrison County Water and Sewer District wants the annexation case dismissed.

Attorney Tim Holleman filed the motion Wednesday. Holleman says the utility district has not been contacted about the annexation by the city.

The motion points to a local and private state law, contending no portion of the utility district can be annexed unless a city annexes the whole territory and takes on district operations and obligations.

The annexation trial has already lasted two weeks and is scheduled to resume Monday.
