JACKSON — Mississippi Attorney General Jim Hood says the state has been awarded $38.2 million in a Medicaid drug-pricing lawsuit.
Hood says a judge found that a pharmaceutical company, Sandoz Inc., inflated the average wholesale prices for its generic drugs.
In a news release yesterday, Hood says the inflated number caused Mississippi Medicaid to lose money by paying pharmacies too much.
Calls to a Mississippi attorney for Sandoz were not immediately returned. It wasn’t clear whether the company, based in Germany, would appeal the ruling.
The case was decided by Thomas Zebert, acting as a special chancery judge in Rankin County.
Former Gov. Ronnie Musgrove represented Mississippi as a private attorney in the lawsuit, filed years after he left office in 2004. Hood’s office says Musgrove’s fees haven’t been determined.
