Diamondhead incorporation opponents want re-hearing

DIAMONDHEAD — Opponents to the incorporation of the Gulf Coast community of Diamondhead have asked the Mississippi Supreme Court for more time to prepare a motion for rehearing.

The opponents filed the motion Wednesday. The deadline to file a motion for rehearing was 5 p.m. yesterday. The opponents want more time to prepare their arguments requesting a further review by the court.

The Supreme Court has not ruled on the motion, according to the court’s web site.

On Oct. 27, the Supreme Court rejected complaints from plaintiffs that the original incorporation petition was improperly filed and a chancellor didn’t let opponents cross-examine witnesses at a hearing.

A judge ruled in 2010 that Diamondhead could incorporate.
