Attorneys for lab owner to ask for dismissal of charges

WATER VALLEY — A hearing is scheduled today on a motion to dismiss the charges against a laboratory owner charged with faking wastewater samples she was hired to test for a company in Mississippi.

Tennie White, who owns Mississippi Environmental Analytical Laboratories Inc., was indicted Nov. 7 in U.S. District Court in Jackson.

The indictment says Borg Warner Emissions Systems Inc. hired White to test wastewater discharge at its car parts plant in Water Valley. The tests were used for reports submitted to the Mississippi Department of Environmental Quality.

The indictment says White created three reports in 2009 that indicated testing had been done, when it had not.

White’s lawyer asked the judge to dismiss the charges, saying the documents weren’t criminal because they weren’t signed and weren’t submitted to a government agency.
