Blue Cross going to court to block Bryant's order

blue crossJACKSON — Mississippi’s largest health insurer is going to court with its fight against Gov. Phil Bryant and 10 Health Management Associates hospitals.

U.S. District Judge District Judge Henry Wingate is scheduled to hold a hearing today on Blue Cross & Blue Shield of Mississippi’s lawsuit.

The insurer wants to block Bryant’s executive order that would make it resume paying in-network rates at 10 hospitals owned by HMA, a company based in Naples, Fla.

If Blue Cross wins a temporary restraining order, it could ignore the governor’s command.

Tuesday, Bryant ordered the hospitals returned to Blue Cross’ network by Oct. 29. Bryant says that without the hospitals, Blue Cross would have an insufficient network under state law.

Blue Cross says Bryant’s order violates federal constitutional guarantees of equal protection and contract protection.
