Aldermen review adult business ordinance, call public hearing

stripper-pole-dancer-silhouette-darrOXFORD — The city of Oxford is holding a public hearing on Dec. 17 on a new ordinance regulating adult businesses.

The Oxford Board of Aldermen reviewed a proposed ordinance this week.

When the city rewrote its land development codes in 2004, the original adult entertainment ordinance was inadvertently left out. The ordinance restricted adult entertainment business to highway business zones.

Without an ordinance, a business could come in and open anywhere because it is illegal to deny an adult, sexually orientated business from opening all together.

“Since then we’ve had two or three phone calls, one a few months ago, inquiring about these type of businesses,” city attorney Pope Mallette told the Oxford Eagle.

“We are attempting to regulate the secondary effects of these businesses, not the freedom of speech,” he said.

Adult entertainment businesses must not be located within 1,000 feet of single-family homes, churches, schools, day cares or parks. Oxford officials are trying to limit such businesses to two areas of the city.

Mallette said before the city can regulate adult entertainment or sexually orientated business it must first prove that such businesses adversely affect the community.

Mallette said since Oxford has no such businesses, it can rely on studies done in other areas.

Other restrictions on sexually orientates business would include no alcohol sales, opaque windows, no lewd physical contact and dancers must be on a stage that is at least 18 inches above the floor level.
