After nearly a decade, landowners settle Paw Paw Road case

WARREN COUNTY — A long-running land dispute in federal court between Warren County and two groups of landowners has been settled.

Terms of the settlement were not made public.

Ken Rector, an attorney representing the county, told the Vicksburg Post neither the county nor anyone else involving in the case is out any money as a result of the settlement.

The case grew out of lower court filings that began in 2003 over the use of Paw Paw Road, a gravel path that leads to adjacent parcels owned by Issaquena Warren Counties Land Company and Paw Paw Island Land Company.

In the federal case, IWCLC has asked for $1 million in damages on each of six counts on the premise that the county intervened on behalf of PPILC in a way that violated the Racketeer Influenced and Corrupt Organizations Act.

In November of 2010, the Mississippi Supreme Court upheld a chancery court ruling that most of the access road is private.

The federal case had been on hiatus since September of 2009 while the state case played out.

From the start, the county contended it was trying to enforce its subdivision and flood plain ordinances. The 1,275-acre tract of land is in dense woods off Mississippi Highway 465, north of Vicksburg, and was under water during last year’s Mississippi River flood.
